Terms & Conditions

Welcome to BOND Creative Direction. 

These Terms & Conditions apply to all services provided by BOND Creative Direction ("BOND", "we", "our", "us"). By confirming a booking, accepting a proposal, signing an agreement or making payment, you agree to these terms.

1. Services

BOND Creative Direction provides bespoke creative services including, but not limited to:

  • Creative direction

  • Brand strategy

  • Content planning

  • Social media consultancy

  • Content creation

  • Photography and videography

  • Creative production

  • Ongoing creative support

Services are delivered under one of the following packages:

Concept – Creative direction, strategy and planning.

Capture – Content creation and production.

Continuity – Ongoing creative partnership combining creative direction and content creation on a monthly basis.

Every proposal is tailored to the individual client and the agreed scope of work.

2. Quotations & Scope of Work

Each project begins with a written proposal outlining the agreed services, deliverables, investment and estimated timelines.

Any work requested outside the agreed scope may incur additional fees and will always be quoted before work begins.

3. Bookings & Payment

Bookings are confirmed once the agreed deposit or full payment has been received.

Invoices must be paid by the due date shown on the invoice.

Unless otherwise agreed:

  • One-off projects require a 50% deposit before work commences.

  • Remaining balances are due prior to delivery of final assets.

  • Monthly retainers are invoiced monthly in advance.

Late payments may delay delivery of work.

BOND Creative Direction reserves the right to pause work until outstanding invoices have been settled.

Ownership and usage rights of final deliverables do not transfer until full payment has been received.

4. Deposits, Rescheduling & Cancellation

Deposits are non-refundable as they secure project dates, creative planning and preparation time.

Should a client need to reschedule, every reasonable effort will be made to accommodate an alternative date, subject to availability.

Should the client cancel:

  • More than 14 days before the project date: no further balance is payable.

  • Between 14 days and 72 hours before the project date: up to 50% of the remaining balance may be charged.

  • Less than 72 hours before the project date: the remaining balance may become payable in full.

If BOND Creative Direction is unable to fulfil a booking due to illness or unforeseen circumstances, every reasonable effort will be made to rearrange the booking. Where this is not possible, any payments relating to services not yet delivered will be refunded.

5. Continuity Package Retainers

Continuity is provided on a monthly rolling agreement.

An initial minimum commitment of three (3) consecutive months applies.

Following this initial period, either party may terminate the agreement by providing 30 days' written notice.

Monthly retainers are invoiced in advance.

Unused shoot time, meetings, strategy sessions or deliverables do not roll over unless agreed in writing.

Should invoices remain unpaid, BOND Creative Direction reserves the right to suspend services until payment has been received.

6. Creative Direction

Creative work is collaborative, however clients acknowledge that artistic interpretation forms part of the service provided.

Unless otherwise agreed in writing, BOND Creative retains creative discretion regarding:

  • styling

  • visual direction

  • editing style

  • pacing

  • composition

  • colour grading

  • content sequencing

  • layout and presentation

The client appoints BOND Creative based upon the creative style and portfolio.

7. Content Creation

Capture sessions may include planning, shot lists, creative direction, filming, photography, editing and content delivery depending on the package selected.

Raw footage is only supplied where specifically included within the agreed package.

Unless otherwise agreed, all delivered imagery and video will be professionally edited in line with the BOND Creative style.

8. Revisions

Unless otherwise stated within the proposal, projects include ONE reasonable round of revisions.

Revisions include minor amendments to copy, sequencing or edits.

Requests that significantly alter the original brief or require additional creative work may incur additional fees.

9. Delivery

Estimated delivery times will be discussed prior to the project commencing.

Delivery schedules may be affected by:

  • delayed client communication

  • late approval of content

  • missing assets

  • third-party suppliers

  • force majeure events

Rush delivery requests may be accommodated where possible and may incur an additional fee.

10. Client Responsibilities

Clients agree to:

  • provide accurate project information

  • supply requested assets on time

  • attend agreed meetings where applicable

  • obtain permission for locations, music or contributors where required

  • review deliverables promptly

  • communicate feedback within agreed timescales

Project timelines may be extended where delays are caused by the client.

11. Intellectual Property

All concepts, strategies, mood boards, presentations, campaign ideas, creative documents, planning materials, graphics, edits and original content remain the intellectual property of BOND Creative unless otherwise agreed in writing.

Upon receipt of full payment, clients receive permission to use the agreed final deliverables for their own business purposes.

Working files, project files, unused concepts and source materials remain the property of BOND Creative.

12. Portfolio & Marketing

Unless otherwise agreed in writing, BOND Creative reserves the right to use completed work, photography, video, behind-the-scenes content and project outcomes within:

  • portfolio

  • website

  • social media

  • presentations

  • awards submissions

  • marketing materials

If a project is confidential or embargoed, this should be agreed before work commences.

13. Third Party Costs

Any external costs including, but not limited to:

  • studio hire

  • venue hire

  • travel

  • accommodation

  • parking

  • props

  • models

  • stylists

  • specialist freelancers

will either be invoiced separately or outlined within the original proposal.

14. Results Disclaimer

While BOND Creative aims to strengthen brand visibility, improve content quality and support business growth, no guarantees are made regarding social media performance, engagement, enquiries, sales or revenue.

Business success depends upon many factors outside the control of BOND Creative.

15. Limitation of Liability

BOND Creative shall not be liable for delays or losses resulting from:

  • platform outages

  • algorithm changes

  • supplier failure

  • equipment failure beyond reasonable control

  • weather

  • transport disruption

  • force majeure events

Liability shall be limited to the total fees paid by the client for the relevant project.

16. Confidentiality

Any commercially sensitive information shared by either party during a project will be treated as confidential and will not be disclosed to third parties without permission unless required by law.

17. Website

All website content, branding, copy, graphics and imagery remain the property of BOND Creative and may not be copied, reproduced or distributed without written permission.

18. Governing Law

These Terms & Conditions shall be governed by the laws of England and Wales.

Any disputes arising shall be subject to the exclusive jurisdiction of the courts of England and Wales.
